Terms of Service

These Terms of Service ("Terms") govern your access to and use of Real Estate Entry (the "Service"), operated by James Wesley McKee Ruiz, doing business as James Wesley Productions (JWP), based in Costa Rica ("we", "us", "our"). By accessing or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility & Accounts

You must be at least 18 years old and legally able to enter into a contract. You are responsible for maintaining the confidentiality of your account credentials (including any third-party sign-in such as Google) and for all activity on your account.

2. Nature of the Service

Real Estate Entry is a software-as-a-service platform that allows real estate professionals to publish listings, build branded profiles, communicate with users, and market properties primarily located in Costa Rica. We are not a real estate broker, agent, lender, escrow agent, appraiser, or party to any transaction between users.

3. User Content & License

You retain ownership of the content you submit (text, photos, video, branding, listings, messages — "User Content"). By submitting User Content you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, adapt, publish, translate, and display the User Content solely to operate, promote, and improve the Service. You represent that you own or have all necessary rights to the User Content and that it does not infringe any third-party right.

4. Acceptable Use

You agree not to misuse the Service. Prohibited conduct is described in our Acceptable Use Policy, which is incorporated into these Terms by reference.

5. Listings Accuracy

Agents and brokerages are solely responsible for the accuracy, legality, and completeness of their listings, including price, location, status, ownership, square meters, zoning, and any representations made. We do not verify listings and do not guarantee their accuracy.

6. Fees, Subscriptions, Refunds

Some features may be offered free of charge; others may require a paid subscription or per-feature fee. Pricing and billing terms will be presented at the point of purchase. Unless required by applicable law, fees are non-refundable.

7. Intellectual Property

The Service, including its name, branding, design, code, and curated content (excluding User Content), is owned by James Wesley Productions (JWP) and protected by copyright, trademark, and other laws. You may not copy, modify, reverse engineer, scrape, or create derivative works except as expressly permitted.

8. Third-Party Services

The Service integrates third-party providers (for example: authentication, mapping, hosting, email delivery, AI translation). Your use of those services may be governed by their own terms and privacy policies.

9. Termination & Suspension

We may suspend, restrict, or terminate access at any time, with or without notice, for any violation of these Terms, our policies, or applicable law, or to protect users or the Service. You may stop using the Service at any time.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF LISTINGS OR USER CONTENT. See our Disclaimer for additional information.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JAMES WESLEY PRODUCTIONS (JWP) AND JAMES WESLEY MCKEE RUIZ WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) USD $50.

12. Indemnification

You agree to indemnify and hold harmless James Wesley McKee Ruiz, James Wesley Productions (JWP), and our affiliates from any claim arising out of your User Content, your use of the Service, or your violation of these Terms or applicable law.

13. Governing Law & Venue

These Terms are governed by the laws of the Republic of Costa Rica, without regard to its conflict-of-laws rules. The competent courts of Costa Rica will have exclusive jurisdiction over any dispute, except where applicable consumer law gives you the right to bring a claim elsewhere.

14. Changes to the Terms

We may update these Terms from time to time. Material changes will be communicated by in-app notice or by updating the "Last updated" date. Continued use after changes constitutes acceptance.
